Builder and Realtor were starting to get pushy with me this morning about closing before they completed some of our requests.... I told them that I was not against pushing closing back until they completed said requests.
Then about a half hour ago the realtor sent me an email stating This:
"please note that per the Contract to Buy page 3, Item 7 Payment, Buyer agrees to close within 5 days of the completion of the home. The completion of the home is the Certificate of Occupancy which I have attached hereto dated 1/8/13. Contractually we cannot hold up closing"
I replied with this:
Well if we are going to pull out the contract, ########### has already breached it by failing to complete the project in 180 days and we can walk away and get our deposits back. I do not feel it is too much to ask and I have given notice when I will be in town and when I would be out of town to schedule this. I do not feel that this should be a deal breaker but I do not appreciate having a contract thrown at us when we have been patient throughout this process"
