I still find it hard to believe that splashing water hydro-locked the engine. Back in my reckless 4x4 days, I used to hit mud holes at 25-30mph taking water clear over the hood. To prevent such a disaster, I ran a piece of mesh screen, sandwitched between two carb base gaskets, between the carb and intake. This would bust up the large gulps of water into smaller, digestible droplets that the engine could pass. Did manage to swamp the engine once before this mod, but didnt hurt a thing........pull plugs, drain water, change oil, back to mud

The flame arrester is designed to prevent ignition of fumes in an enclosed area it does this by offsetting the pathway that the flame must travel thus extinquishing it, at the same time it must let air in to feed the combustion process and since air and water can travel the varied path through the overlapping screens you can ingest water as well as air. If you made it water tight it would not breath.

Seeing the picture (worth a 1,000 words), I concur that the intake is in a stupid spot for a V drive application. Of course, all V drive rig ups are not as easy to deal with as DD. (That's why my Tige is DD) That having been said, you would either have had to take a HUGE, & I MEAN HUGE roller over the stern of your boat, or have had 1.5, 2 feet or more of water in your bilge to have taken in enough water in the air intake to have hydrolocked the engine.
The engine air intake set up looks more like it was meant to be used w/ a stern drive application, so it would be pointing toward the bow of the boat and not the stern. That having been said, I hope you get your rig fixed. If it's under warranty, it should be on Tige or the dealer.
If no warranty, I doubt you will have much luck w/ a "design defect" case. Do you have a design expert ($5K-$10K up front) who will testify under penalty of perjury that the rigging of the engine in your particular boat was defective? Do you have your contingent fee lawyer lined up? Do you have the $10K to $30K in costs (not legal fees) to prosecute your case with your contingent fee lawyer? Can you afford the 1-2.5 years an appeal will take if you win? (voice of 18 years trial experience) Maybe a class action, huh ..........
There was a great thread on Hot Boat a year or two ago that should be mandatory readiing for anyone posting they are going to sue a boat manufacturer. The Plaintiff won........something like $1,500 after year or more of litigation, and a claim of hundreds of thousands of dollars for fraud, etc.. His lawyer fees had to be 10x his award. Great way to spend 12 months of your life, eh?

no, heck no, i'm not suing anybody. i had just hoped there had been some issues with this already or that they might just be willing to help a little. plus, i doubt warranty would have covered this?
hydrolock may mean different things to different people? the engine did die. now it will run but with a knock. my mechanic says the combustion chamber of a cylinder is about 80cc if i understood him. that's less than 3 oz. lets say it sucks in a cup full, but puts 3 oz. in one cylinder. you're done.
i flipped up the motor cover on my buddie's mastercraft DD yesterday. filter on the intake. might have killed the power a little while, but that would have saved my engine.
