In Mississippi and SC the DNR would probably stop you just to figure out what the crap you were doing if you were surfing. The lakes I go to never have DNR on them anyways because of such little boat traffic.
IN the entire year we were on the river is SC, Only one day did I see DNR and that was because they were sponsoring a free safety check that dayEverything happens for a reason

In california, the law states that you cannot ride on the transom, or on the gunwales while the boat is "under way". I was informed by one of our local rangers on lake oroville, that underway does not mean MOVING. He said it means moving and ON PLAIN. He did say that not all rangers are as versed as he was, and will cite you if you are just moving. I have searched on the web, and did not find a clear definition of "under way", so I guess it can be up to interpretation. When we surf, we are definitely NOT on plain.
We ride on the transom and gunwales all the time while surfing, it helps to take the best pictures, and get the best wake. The farther the weight is from the center, the more you can list the boat over.
This is one of the great things about living near a lake not as populated as others, and even better because we go during the week. We have gotten to know the rangers, and they know us, and don't hassle us at all.
If anyone finds anymore info on "under way", it would probably help in fighting a ticket, or keeping on board, at least in california.http://wake9.com/

I think it's illegal here, too. I have had the water patrol watch what we were doing but they never stopped us. I think they wondered if I was on plane while wakesurfing.
