In Texas the open container law does not apply to boaters.

California has the same sort of laws. Open containers don't apply to boating, but .08 is presumed intoxicated and .05 to .08 can be inferred with other evdence.
The under 21 is more stringent:
"A person under 21 with a BAC of .01% or more may not operate any motorized vessel, or manipulate water skis, an aquaplane, or similar device."
I've heard accounts where deputies have used the "manipulate water skis" to mean even if you try to strap on your wakeboard, the under 21 can be cited.Buy my kid's board! http://www.flyboywakesurf.com

READING THE LAWS: don't tell but, by the time I fixed my bent prop (tools and all) it was over $500. When my daughter broke her ear drum, I took her to a doc in a box. (no 911 and I didn't set on my hands till DNR showed up). and I think I've gone faster than 55 mph going to the lake. (never back). Do they need or want that much control?
