      Well, good luck. It will be a tough road. Insurance will total the boat and you will be out the deductible that you carry. That is about all the courts will award you as that was your only property damage. You could try for punitive damage but you would have to show intent.

      Your insurance will be able to go after the other boater to recover what they had to pay. More often than not the insurance company just gives up.

      Everyone that was in your boat needs to go to a doctor and be checked out. You may have injuries of which you are not aware. It also provides additional documentation that can be used by authorities. Anytime there is an injury involved the charges against the other operator can be significantly harsher.

      The best bet is going to be with charges from law enforcement. But even then you may not get much satisfaction. Work with the law enforcement to get the guy punished as much as possible.

      I say this from a recent auto accident with some loser. I was still out a lot of money and the hopes of recovery were slim to none. And my legal fees to try and go after the low life creatin would have just cost me more money with little chance of recovery.

      But don't make it an all-consuming vendetta. It's like mud wrestling with a pig. You both get dirty but the pig likes it.

        OMG, glad that everyone is okay. That Tige took a HUGE hit and to take that much fiberglass off, WOW!!!!!

        I hope that the other boat gets what he deserves. Keep us informed.

            Wow is about all I can say. Glad everyone is OK. My biggest fear driving at night has always been hitting a rock not another boat hitting me. Good luck with the claim...I hope all works out for you.

              Damn dude! Glad you guys are ok. He must have been moving along at a pretty good clip to do that much "clean" damage. What a douch. I hope you are able to run this CS'r into the ground.

                Wow...thats scary as ****! Had your gf not seen him, or him see you and turn the same direction you did...amazingly luckily. Odds in that situation are not in your favor that you walked away...hope that stupid **** realizes how lucky he is he didnt kill someone. Glad everyone is ok.

                        Man sorry to hear that happened to you. Thankfully everyone is ok. Couldnt imagine if someone got hurt. Funny how you say you started throwing everything out of the boat after it happened guess you gotta save what you can right. Anyways keep us posted on what happens. May I ask what insurance company you have and how smoothly this goes for you?? Anyways good luck with everything, was a nice boat.

                          adjuster went out today, he wrote it off total loss, he said he could see it was submerged before he even got out of his car.....

                            Best of luck to you.

                            I have little doubt the driver of the other boat was intoxicated as they would have little other reason to leave you guys behind.

                            In some states not stopping to render aid after you have been involved in an accident where there is potential for loss of life is a felony.

                            Hopefully your state is one of them.

                            I really hope your turn around is quick for the new boat!

                                Glad no one involved was hurt. A water collision at 30-40mph would have felt like 75-80mph in a vehicle I would imagine. A wakeup call indeed. Good luck with the insurance claim for a new boat, keep us posted.
